PETALING JAYA: A factory worker was today sentenced to three months’ imprisonment by the magistrates’ court in Ayer Keroh, Melaka, after he pleaded guilty to outraging the modesty of a female jogger last week.
Ridzuan Yusof, 28, made his guilty plea after the charge was read to him by a court interpreter before magistrate Sharda Sheinha Suleiman, Berita Harian reported.
Based on the facts of the case, Ridzuan was accused of deliberately using criminal force against a 20-year-old woman by approaching her from behind before covering her mouth and molesting her.
He fled the scene when the victim screamed for help. The woman later filed a police report against him.
He was accused of committing the offence at a recreational park in Taman Bandaraya Bukit Serindit about 10pm on April 10.
The charge was framed under Section 354 of the Penal Code, punishable with up to 10 years’ imprisonment or a fine, or both, upon conviction.
Ridzuan’s lawyer, Izzuddin Ab Malek asked the court to consider a lighter sentence as his client had a learning disability and only earned RM1,500 a month to care for his family.
Deputy public prosecutor Wardah Isshar, however, asked for a heavy sentence to be handed down.
“The offence was committed in a public place, against a woman, and at night.
“The fact that the accused has a learning disability is not grounds for a lighter sentence, as he does not suffer from any mental disability,” she said.
The magistrate ordered the accused’s three-month sentence to be served from the date of his arrest, April 11.
